Harvey Weinstein's 2020 rape conviction overturned by New York appeals court Harvey Weinstein’s 2020 rape conviction was overturned Thursday in New York, making way for a new trial. The state Court of Appeals found that the judge in the landmark #MeToo trial prejudiced the former film mogul with improper rulings, including a decision to let women testify about allegations that weren’t part of the case. “We conclude that the trial court erroneously admitted testimony of uncharged, alleged prior sexual acts against persons other than the complainants of the underlying crimes because that testimony served no material non-propensity purpose,” the court said in a 4-3 decision. “The court compounded that error when it ruled that defendant, who had no criminal history, could be cross examined about those allegations as well as numerous allegations of misconduct that portrayed defendant in a highly prejudicial light,” it said. www.nbcnews.com/news/us-news/harvey-weinsteins-rape-conviction-overturned-rcna149328Wow. This is why prosecutors and judges have to be on point every single step of the way.

Whoa!
I did not see that coming.
For what it is worth, it is not like the guy is going to start producing movies again or go back to the status and reputation he had back in the 90s and 2000s.
Still kind of stunned.

He's still going to serve out a 16 year sentence from a different conviction in Los Angeles.

Two legal standards: what applies to the wealthy, and what applies to everyone else. The story of American jurisprudence.

He's going to be turned over to California to serve his time for his rape conviction there. Not sure whether there will be any sort of practical fallout from this decision or not. He's got 16 years to serve in California. He's got several chronic medical conditions and is 72. He should be closing in on 90 - if he lives that long - when he's released. New York could try to put together a new trial. I'm not sure how his victims will feel about testifying again. For probably not much purpose. The real issue here is how the New York prosecutors conducted themselves.

That's double jeopardy Perhaps a different woman could come forward with charges. Perhaps that is what you're saying

I was really hoping this pig would take his last breath in prison.
Send him to CA. Let him pay his dues there until NY can get their S together.
So tired of prosecutors and judges failing to do their jobs.

Cyrus Vance,Jr. was the DA at the time Weinstein was convicted. www.pbs.org/newshour/amp/show/manhattan-da-cyrus-vance-on-weinstein-verdict-and-why-his-office-didnt-prosecute-in-2015Cyrus Vance Jr. is the Manhattan district attorney who brought felony sex charges against Hollywood producer Harvey Weinstein, who was convicted on two counts Monday. But Weinstein was acquitted of the most serious charges, including predatory sexual assault. What does the result mean for future prosecution of sex crimes, and why wasn’t Weinstein charged earlier? Vance joins Amna Nawaz to discuss.

Yes, but if there is any incompetence involved it was done by the DA office that prosecuted and obtained the 2020 conviction, not the current DA who’s trying to clean up the mess.

Bragg has spent his time in the DA's job reducing and dropping charges for everyone not named Donald Trump... and his attempt to fabricate a case against Trump is a disaster. His incompetence has been on full display for everyone to see since he took office. Trying to navigate re-trying Weinstein without tripping over the double jeopardy problem is likely beyond his very limited ability.
